General Terms and Conditions "AGBs"
1. General
Only the following Terms and Conditions shall apply. Any deviations from these terms are valid only if confirmed in writing by Trikombin Österreich – Peter Lindpointner (hereinafter referred to as the “Seller”).
2. Professional protection
Trikombin devices and accessories, DTS test kits, Trikombin licenses and libraries may only be purchased by doctors, therapists, naturopaths or healthcare facilities and are therefore not for resale!
3. Delivery
In-stock items are generally delivered within 3–4 working days. Items that are not in stock will be shipped as soon as possible. Some products may not be shipped to all neighboring countries. We reserve the right to decline online orders. In such cases, any payment already made to us, e.g. by credit card, will be automatically refunded.
4. Online prices:
The current prices apply and are always available on the PureLebensenergie Fa. Peter Lindpointner online shop.
5.1. Discounts on online prices:
Discount codes can only be applied to the prices listed in the online shop! Discount codes cannot be used in addition to reseller discounts, which are not shown in the online shop!
5.2. Discount codes:
Discount codes issued by us can only be redeemed during the validity period stated and subject to the conditions in effect at the time of redemption.
Discount codes designated as “unlimited duration” are subject to our unrestricted right to amend or revoke them. We reserve the right to amend, restrict or deactivate such discount codes at any time and without giving reasons.
If we change or discontinue a discount code with no expiry date, there is no legal entitlement to an extension, reinstatement of its validity or any other compensation.
6. Payment Method
New customers and consumers: Payment in advance or by credit card in our online shop!
Existing customers such as doctors, therapists and resellers: 20 days net!
Purchase of a Trikombin device with accessories: advance payment only!
Bank transfers (advance payment or on invoice) from Switzerland:
If you do not have your own euro account, please make the transfer with the option “Sender pays all fees.” If you choose another transfer option, please note that we will have to charge you for any additional bank fees charged to us by our bank.
7. Product Returns
- As a general rule, products and goods cannot be returned. This includes, for example, DTS therapy ampoules, used chip cards, opened packages of consumables, opened food supplements (including in cases of intolerance after taking them), books, etc.
- A Zapper may be returned within 14 days of receipt, subject to the following conditions. From the first use onward, wrist cuffs, abdominal belts, etc. will be charged for hygienic reasons, as will any cables showing signs of use. Returns are not accepted if the Zapper or fractal antenna shows signs of use.
- A Trikombin device may only be returned if this has been agreed separately at the time of ordering. The return period for a Trikombin device may be agreed for a maximum of 4 weeks (28 days) from delivery. If a return has been agreed and the device shows signs of use, it can no longer be returned at the full purchase price. The seller will determine an appropriate deduction based on signs of use or any damage. Any licences or libraries purchased separately will always be deducted in the event of a return.
- Postage costs are non-refundable in the event of a return, except when defective goods have been delivered. In that case, the goods will be exchanged and sent again at no additional shipping cost.
You may also use the electronic withdrawal function available on our website to withdraw from your contract. Any personal data submitted in this way will be processed solely to handle your withdrawal. The relevant withdrawal notice applies to the respective sales channel (e.g. online shop, online order or other electronic ordering methods).
8. Resale Products
The following products available in the online shop are eligible for resale:
Diamond Shield Zapper and all accessories, Mannayan dietary supplements and colloidal products, Nutramedix, Norsan, Vitality, products for electrical and water pollution, specialist books!
9. Reseller Discounts
Reseller and volume discounts are intended exclusively for doctors, therapists, naturopaths, energy practitioners, healthcare facilities and retailers. The quantity purchased must be proportionate to typical resale volumes. Discount rates on products for resale vary and can be requested at any time directly from Trikombin Österreich Fa. Peter Lindpointner at office@trikombin-oesterreich.at.
9.1 automatic discount deduction for resellers:
For existing customers, resale discounts are automatically deducted from orders placed in the online shop, even if the reseller places an order at regular retail prices.
9.2 What are not resale products:
Trikombin devices, Trikombin accessories, DTS test kits, as well as Trikombin licenses and libraries are generally not resale products. No resale discounts can therefore be applied to these items, as they are not intended for resale to end consumers.
9.3 How do I become a reseller:
Upon submission of appropriate proof, you can be listed as a sales partner. Contact us here and send the relevant documentation to office@trikombin-österreich.at. Reseller discounts on lower-priced products are sometimes only available for larger order quantities. In general, the quantity ordered over the course of the year must clearly constitute a resale quantity. Reseller discounts are not available to businesses that use our products only for their own needs.
9.4 Diamond Shield Zapper Resellers:
If you purchase at least 4 Diamond Shield Zappers with your first order, you will automatically be registered as a reseller. If you initially order only 1 or 2 devices, the reseller discount will be credited later once you have sold a total of 4 Diamond Shield Zappers within 12 months. To qualify as a reseller, you must sell at least 4 devices within a 12-month period. You can redeem this credit with your next order, or we can transfer the credited amount to your business account!
Trikombin doctors and therapists are automatically resellers!
10. Leasing options
Trikombin purchasers may generally lease the device. Trikombin Österreich will put you in touch with a leasing bank. To lease a device, you must have been self-employed for at least 18 months! If the leasing bank is unable to arrange a lease with the customer due to insufficient liquidity or a lack of a viable business plan, Trikombin Österreich Peter Lindpointner shall be held harmless from any claims or liability. No purchase contract is therefore formed between the customer and Trikombin Österreich Peter Lindpointner. If a purchase contract has already been formed, the buyer must arrange alternative financing for the device or the purchase contract must be declared invalid. The full initial package can be leased, including all test ampoules, licenses and libraries.
11. Hire Purchase
Trikombin purchasers are generally eligible for a rent-to-own option. The rent-to-own option is limited each year, which means that if Trikombin Österreich already has a high number of rent-to-own devices committed for a given year, it may not be able to offer a rent-to-own option to additional interested customers during that same year. The quota depends on the general market situation at the time.
Requirements:
- Test ampoules cannot be included with the rent-to-own option.
- Licences and libraries can be included in the hire-purchase agreement.
- The rent-to-own option can be arranged over three or a maximum of four years. The device, together with the ordered licenses and libraries, becomes the buyer’s property only after the final installment has been paid in full.
- New self-employed persons must submit a suitable business plan covering at least 3 years. Established therapists, doctors and naturopaths with an active practice do not need to submit a business plan.
- The down payment must be at least € 5000,- net!
- Payment of the monthly installment is made exclusively by direct debit!
Early termination of contract:
- Returns of the Trikombin are generally not possible during the first 12 months. From month 12 onward, returns are possible monthly.
- You must give written notice of your intention to return the device at least 3 months before the desired return date.
- The monthly installments paid up to the time of return, including the down payment made, are considered rent only and cannot be deducted or offset in any other way, nor will they be refunded to the buyer.
- In addition, in the case of unusual signs of wear during the rental period, improper handling or damage, the seller may apply an additional corresponding depreciation. The resulting costs will be charged to the customer by the seller.
Rental cost calculation:
The monthly rental costs are calculated in advance when the contract is signed, taking applicable bank fees and interest into account, and presented to the customer as an offer for signature on behalf of the company.
If the European key interest rate changes by more than 0.25% during the hire-purchase agreement, the monthly instalment will be adjusted accordingly. As a rule, the calculation is based on the Euribor plus 2%!
Example of a rent-to-own option for a purchase in November 2023:
Equipment or financing amount:
Trikombin Special Edition € 19.800,- net; € 23.760,- incl. tax
Deposit (1st large instalment) €5000 net, €6000 incl. tax!
36 monthly instalments of €449 net each; €538.80 incl. tax
Financing based on 6% interest!
The test kits purchased and included in the Special Edition remain with the customer even if the agreement is terminated!
If the hire-purchase agreement is cancelled, a cancellation fee of € 1000,- net, € 1200,- including tax will be charged for the test kits. This amount is due within 14 days, net!
Further terms:
The hire-purchase agreement is made directly with Trikombin Österreich. Should Trikombin Österreich Peter Lindpointner reject the hire-purchase option, Trikombin Österreich must be held harmless from any claims. No purchase contract will therefore be formed between the customer and Trikombin Österreich Peter Lindpointner. If a purchase contract has already been formed, the buyer must arrange alternative financing for the device, or the purchase contract must be declared invalid.
12. Right of withdrawal
If an order is cancelled, any resulting costs are borne by the customer.
13. Retention of Title
The products remain the property of Trikombin Österreich – Peter Lindpointner until paid for in full.
14. Warranty
- We provide a 3-year warranty on new Trikombin devices from the shipping date!
- We offer a 2-year warranty on new Zapper devices from the date of dispatch!
- Damage caused by the customer or user is not covered by the warranty!
15. Trikombin Österreich seminars
- 15.1. Trikombin Österreich Peter Lindpointner acts as the organizer of the training courses offered. The individual instructors are responsible and liable for the training content they deliver.
- 15.2. Event fees are set individually for each seminar and workshop.
- 15.3. Registrations are processed in order of receipt (postmark or email date). The maximum number of participants for seminars/workshops is determined according to the type of event. Registrations must be submitted in writing only (email, post or registration form on the website) and are binding. Online registration is binding once the terms and conditions have been accepted. Verbal agreements are not valid. Reservations are not accepted. If all places are booked before the event starts, a waiting list will be created.
- 15.4. After we receive your registration, we will send you an order confirmation stating the deposit amount and payment deadline. The deposit is 30% of the total amount. Your place is confirmed only once the deposit has been received. If the deposit is not received, Trikombin Austria Peter Lindpointner reserves the right to offer the place to someone else if there is a waiting list.
- 15.5. The full event fee must be paid no later than 6 weeks before the event starts, in accordance with the payment terms stated on the order confirmation for the total amount (see above). If payment is not received, Trikombin Österreich Peter Lindpointner reserves the right to offer the event place to someone else if there is a waiting list. Any deposit already paid will not be refunded in this case. If you register less than 6 weeks before the event starts, the full event fee is due immediately upon registration.
- 15.6. Cancellations must be submitted in writing no later than 6 weeks before the start of the respective event, and are only valid once gesund beschwingt KG has sent written confirmation and a cancellation confirmation (by email, post or fax). In this case, the fees paid will be refunded minus a processing fee of € 20,00. For cancellations made within 6 weeks of the start of the respective event, 100% of the booked service will be charged. If the originally booked seminar/workshop is rescheduled to another date, the cancellation fee will be waived.
- 15.6.1 If a participant is unable to attend the event, they may transfer their contractual relationship to another person. The organiser must be notified of the transfer in writing. The transferor and transferee are jointly and severally liable for any outstanding fees and, where applicable, any additional costs arising from the transfer.
- 15.7. To the extent permitted by law, Trikombin Österreich Peter Lindpointner accepts no liability for personal injury or property damage at its events. Attendance at events is at your own risk.
- 15.8. Trikombin Österreich Peter Lindpointner expressly reserves the right to make changes to the advertised events, dates and schedules. This also applies if the event leader or a speaker is unable to attend at short notice. In this case, Trikombin Österreich Peter Lindpointner will endeavour to arrange a suitable replacement. If this cannot be guaranteed, the event will be rescheduled for a later date.
- 15.8.1 If there are too few participants, an event may be cancelled without replacement or postponed to a later date. Any payments made by participants (deposits or event fees) will then be refunded in full without delay. No further claims may be made against Trikombin Österreich Peter Lindpointner. Participants will be notified in good time of any date cancellations (up to one week before the event)!
- 15.9. Materials for the events may be provided in printed or electronic (.pdf) format. Please note that all copyright in the event materials (scripts, copies, etc.) remains with Trikombin Österreich Peter Lindpointner or the respective author and creator of the materials. Printed script materials are not guaranteed.
- 15.10. Trikombin Österreich Peter Lindpointner uses personal data such as names, addresses, dates of birth, job titles, email addresses and telephone numbers exclusively for informational purposes (e.g. newsletters) and to promote events organized by Trikombin Österreich Peter Lindpointner. By accepting the terms and conditions when registering, participants consent to this. Participants may withdraw their consent at any time. This withdrawal must be submitted in writing (email is sufficient).
- 15.10.1 At our events, photographs and/or videos may be taken by or on behalf of Trikombin Österreich Peter Lindpointner. By registering for the event, you acknowledge that photographs and video footage featuring you may be used for press coverage and published across various (social) media, publications and on the websites of Trikombin Österreich Peter Lindpointner.
